Selling in New Jersey: the rules at a glance

Foreclosure
- How it works
- Judicial. Cases run through the Superior Court, Chancery Division, and its Office of Foreclosure (NJ Courts). Most servicers cannot file until you are more than 120 days behind (12 CFR 1024.41(f)).
- Notice first
- The lender sends a Notice of Intention to Foreclose, which gives you 30 days to cure the default.
- Court deadlines
- You have 35 days after service to answer the complaint, and free foreclosure mediation is available.
- Sheriff sale
- The sheriff has 150 days from the writ of execution to auction the property. After the sale, you have 10 days to redeem.
Inherited houses and probate
- Probate office
- Wills are probated at the county Surrogate's Court, for example the Mercer County Surrogate in Trenton.
- Estate tax
- New Jersey has no estate tax for deaths on or after January 1, 2018. To transfer New Jersey real estate, the estate generally needs a tax waiver; property held as tenants by the entirety does not (NJ Division of Taxation).
- Inheritance tax
- Charged by beneficiary class. Class A beneficiaries, such as a spouse, children and parents, pay no inheritance tax (NJ Division of Taxation).
Realty Transfer Fee
- Who pays
- The seller is responsible by law (NJ Division of Taxation).
- Rate
- Charged per $500 of the price. Up to $350,000: $2.00 per $500 on the first $150,000, $3.35 to $200,000 and $3.90 to $350,000 (RTF rates). Sellers 62 or older, blind or disabled may qualify for reduced rates (Form RTF-1).
- Over $1 million
- For deeds recorded on or after July 10, 2025, a seller-paid Graduated Percent Fee of 1% to 3.5% of the full price also applies (Division of Taxation notice).
Unpaid property taxes
- Tax sale certificates
- Your municipality sells a lien on the unpaid taxes. A private certificate holder can file to foreclose two years after the sale, and a municipality after six months. Since 2024 the owner can ask the court for a sale that preserves their equity instead (P.L.2024, c.39).
What this means if you're selling
Behind on your mortgage
The 30-day notice and the 35-day answer window are your first chances to act. A sale that closes before the sheriff auction pays off the loan from your proceeds.
Inherited a house
The executor appointed by the Surrogate signs the deed, and the estate usually needs a tax waiver to transfer the house. We buy as-is and can wait for the paperwork.
Costs at closing
New Jersey puts the Realty Transfer Fee on the seller. See how it compares with PA, DE and FL in our transfer tax guide.

How long does foreclosure take in New Jersey?
It goes through the Superior Court, so it takes months at minimum. You first get a Notice of Intention to Foreclose with 30 days to cure, then 35 days to answer the complaint, and the sheriff has up to 150 days from the writ to hold the sale.
Can I get my house back after a sheriff sale in New Jersey?
For a short time. New Jersey Courts say the homeowner has 10 days after the sheriff sale to redeem. Selling before the sale avoids that race.
Who pays the realty transfer fee in New Jersey?
The seller. The fee is charged per $500 of the price, with reduced rates for some sellers 62 or older, blind or disabled, and a seller-paid graduated fee on sales over $1 million.
Do I need a tax waiver to sell an inherited house in New Jersey?
Usually, yes. The NJ Division of Taxation requires a tax waiver to transfer a decedent's New Jersey real estate, except property held as tenants by the entirety.
Does New Jersey still have an estate tax?
No, not for deaths on or after January 1, 2018. The separate inheritance tax still applies to some beneficiaries, but Class A heirs such as a spouse or children pay none.
Do you buy houses everywhere in New Jersey?
We buy in Trenton and nearby Mercer County towns, and often beyond. Send your address and we'll tell you right away.
