Selling in Florida: the rules at a glance
Foreclosure, probate and closing-cost rules set by Florida law, in plain English. Each fact links to the official source.

Foreclosure
- How it works
- Judicial. Cases are filed in the county circuit court, and most servicers cannot file until you are more than 120 days behind (12 CFR 1024.41(f)).
- Sale date
- The clerk sells the property 20 to 35 days after the final judgment, and many counties hold the sale online (Fla. Stat. § 45.031).
- Redemption
- You can redeem until the clerk files the certificate of sale, or later if the judgment says so (Fla. Stat. § 45.0315). Objections are due within 10 days after that certificate is filed.
Inherited houses and probate
- Probate office
- Probate runs through the circuit court; the county Clerk of Court's probate division handles the filings.
- Summary administration
- The simpler process is available when the estate (less exempt property) is $150,000 or less, or the person died more than two years ago (Fla. Stat. § 735.201). The limit rose from $75,000 in 2026 (CS/HB 1337); ask a probate attorney which limit applies to your case.
- Creditors and homestead
- Creditors generally have three months after the first notice is published to file claims (Fla. Stat. § 733.702). A homestead cannot be left by will if the owner is survived by a spouse or minor child, except to the spouse when there is no minor child (Fla. Const. art. X, § 4(c)).
Documentary stamp tax
- Rate
- 70 cents per $100 of the price on the deed; in Miami-Dade 60 cents, plus a 45-cent surtax on property other than a single-family home (Florida Department of Revenue).
- Who pays
- All parties to the deed are liable, whoever agrees to pay it. The contract sets the split.
Unpaid property taxes
- Tax certificates and deeds
- The county Tax Collector sells a tax certificate on unpaid taxes. If it isn't redeemed, the holder can apply for a tax deed after two years from April 1 of the year the certificate was issued (Fla. Stat. § 197.502).
What this means if you're selling
Behind on your mortgage
The window between the final judgment and the clerk sale is short, 20 to 35 days. Selling before then, or redeeming before the certificate of sale, keeps your equity in your hands.
Inherited a house
Many Florida estates now fit summary administration. Homestead rules can limit who receives the house, so get that settled, then we can buy it as-is.
Costs at closing
Doc stamps on a $250,000 sale come to $1,750 outside Miami-Dade. See the four-state comparison.
Florida selling questions
Still have a question? Call or text (215) 703-9223 or email info@eternalhomebuyers.com.
How long after the final judgment is a Florida foreclosure sale?
Florida law sets the clerk sale no less than 20 and no more than 35 days after the final judgment. Many counties, including Duval, Orange and Hillsborough, hold the sale online.
Can I stop a Florida foreclosure after the judgment?
You can redeem until the clerk files the certificate of sale, or a later time set in the judgment, by paying what the judgment requires. A sale that closes before then also pays off the loan.
Who pays doc stamps when I sell a house in Florida?
The law makes all parties to the deed liable, so the contract decides who pays. The rate is 70 cents per $100 of the price outside Miami-Dade.
What is summary administration in Florida?
A shorter probate process. Under the 2026 statute it is available when the estate, less exempt property, is $150,000 or less, or the person died more than two years ago.
Can a Florida homestead be left to anyone in a will?
Not always. The Florida Constitution says a homestead cannot be left by will if the owner is survived by a spouse or minor child, except to the spouse when there is no minor child.
Do you buy houses everywhere in Florida?
We buy in and around Jacksonville, Orlando and Tampa, and often beyond. Send your address and we'll tell you right away.
