Selling in Delaware: the rules at a glance
Foreclosure, probate and closing-cost rules set by Delaware law, in plain English. Each fact links to the official source.

Foreclosure
- How it works
- Judicial. The lender sues in the Superior Court of the county with a writ of scire facias on the mortgage (10 Del. C. § 5061). Most servicers cannot file until you are more than 120 days behind (12 CFR 1024.41(f)).
- Mediation
- For owner-occupied one- to four-family primary homes, the lender cannot get a judgment until the mediation step is done (10 Del. C. § 5062C).
- Sheriff sale
- After judgment, the county sheriff sells the property. Check your county sheriff's page for dates, such as New Castle County Sheriff Sales.
Inherited houses and probate
- Probate office
- Each county has a Register of Wills: New Castle, Kent and Sussex.
- Small estates
- The small-estate affidavit covers personal estates of $50,000 or less, 30 days after death, and only if the person did not own Delaware real estate in their name alone or as a tenant in common (12 Del. C. § 2306). A house in their name usually means a full estate.
Transfer tax
- Rate
- The state rate is 3%, or 2.5% where the town or county charges the full 1.5% local tax, which makes 4% in total there (30 Del. C. § 5402).
- Who pays
- The law apportions it equally between seller and buyer. A first-time buyer's reduction comes off the buyer's half only (Delaware Division of Revenue).
What this means if you're selling
Behind on your mortgage
Delaware's mediation step gives owner-occupants time before any judgment. Use it to compare options, including a sale that pays off the loan.
Inherited a house
If the house was in the person's name alone, expect to open an estate with the county Register of Wills. We buy as-is and can wait for the personal representative.
Costs at closing
Where the full local tax applies, the seller's half is 2% of the price. See the four-state transfer tax comparison.
Delaware selling questions
Still have a question? Call or text (215) 703-9223 or email info@eternalhomebuyers.com.
Is Delaware a judicial foreclosure state?
Yes. The lender has to sue in the Superior Court with a writ of scire facias on the mortgage, and the county sheriff sells the house after judgment.
What is Delaware's foreclosure mediation program?
For owner-occupied one- to four-family primary homes, Delaware law requires a mediation step before the lender can get a judgment. It is a chance to work out a modification, a payment plan or a sale.
How much transfer tax does a seller pay in Delaware?
Half of the total. Where the full local tax applies, the total is 4% (2.5% state plus 1.5% local), so the seller pays 2% of the price.
Can I use a small estate affidavit to sell a parent's house in Delaware?
Usually not. The affidavit is only for personal estates of $50,000 or less and isn't available if the person owned Delaware real estate in their name alone or as a tenant in common, so the estate normally goes through the Register of Wills.
